Terms of Service

1. Introduction & Acceptance

Brandfy (the “Service”) is operated by Liam Villalba, a registered self-employed professional (“autónomo”) in Barcelona, Spain. You can reach us at hello@brandfy.io.

By creating an account or using Brandfy, you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. Service Description

Brandfy is a SaaS platform for organizing, managing, and presenting brand assets. Users upload visual assets (logos, images, graphics) organized by digital platform with preloaded technical specifications.

The Service includes:

  • Asset storage organized by section and platform
  • Brand color palettes and typography management
  • Team collaboration with role-based access
  • Shared project links (“guided tours”)
  • Public portfolios

3. Account Terms

  • You must be at least 16 years old to create an account.
  • One person per account. Accounts are not transferable.
  • You are responsible for keeping your account secure. Authentication is handled by Clerk; you must protect your credentials.
  • You must provide accurate and up-to-date information.

4. Plans and Pricing

  • Free plan: €0 per month (limited features).
  • Pro plan: €9.99 per month.
  • Agency plan: €19.99 per month.

Prices may change with at least 30 days’ notice. Payments are processed securely via Stripe. Subscriptions renew automatically; you can cancel at any time and your access will continue until the end of the current billing period. No refunds are issued for partial months.

5. User Content & Intellectual Property

  • You retain all rights to your content (assets, images, brand materials).
  • You grant Brandfy a limited, worldwide, non-exclusive license to host, store, and display your content solely to provide the Service to you and the people you share it with.
  • You represent and warrant that you have the right to upload the content you submit and that it does not infringe any third-party rights.
  • Brandfy does not claim ownership of your content.
  • Brandfy’s own branding, code, and design are proprietary and protected by intellectual property laws.

6. Acceptable Use

You agree not to:

  • Upload illegal content or content that infringes others’ rights.
  • Upload malware or files intended to harm the Service or its users.
  • Impersonate any person or entity.
  • Attempt to reverse-engineer, scrape, or otherwise abuse the Service.

We reserve the right to remove content or suspend accounts that violate these terms.

7. Storage & Data

  • Files are stored on Cloudflare R2 (EU region).
  • Storage limits vary by plan: Free (500 MB), Pro (5 GB), Agency (20 GB).
  • Upon account deletion, your data will be permanently removed within 30 days.

8. Shared Links & Public Portfolios

  • “Guided tour” links make project content viewable by anyone who has the link.
  • Public portfolios are visible to everyone on the internet.
  • You are responsible for what you choose to share publicly.

9. Team Collaboration

  • Account owners can invite team members with roles (Editor, Viewer).
  • The account owner is responsible for their team members’ actions within the project.

10. Availability & Modifications

  • We aim for high availability but do not guarantee 100% uptime.
  • We may modify, suspend, or discontinue features with reasonable notice.
  • For paid plans, material changes will be communicated at least 30 days in advance.

11. Limitation of Liability

  • The Service is provided “as is”, without warranties of any kind.
  • Brandfy is not liable for loss of data, revenue, or indirect damages.
  • Our maximum aggregate liability is limited to the amount you paid to Brandfy in the 12 months preceding the claim.
  • Nothing in this section affects your rights as a consumer under EU law.

12. Termination

  • You can delete your account at any time from your settings.
  • We can terminate accounts that violate these terms, with reasonable notice where possible.
  • Upon termination, your data will be deleted within 30 days.

13. Governing Law

  • These terms are governed by the laws of Spain.
  • Disputes shall be resolved in the courts of Barcelona, Spain.
  • EU consumers retain their rights under local consumer protection laws.
